Tulsa woman accused of forging deed to steal home, tied to $100K fraud involving elderly victim

Investigators say the suspect, arrested in Muskogee, also targeted an 85-year-old man with dementia in a separate case.

US Marshals arrest a Tulsa woman in Muskogee who is charged with stealing a woman's home by creating a fake quitclaim deed and filing it with the county clerk's office.

Tulsa County Sheriff's Office Investigators say Briana Points is also a suspect in another case where Points and three other suspects are accused of stealing more than $100,000 from an 85-year-old man with dementia.

One Tulsa County investigator was working on the stolen house case and another was working on the case involving the 85-year-old victim and they later realized they were dealing with the same suspect, Points, who has a history of theft and fraud.

How were deputies notified about the house?

Investigators say Points and her boyfriend were living in a woman's rent house in Turley, but the homeowner didn't know them and didn't give them permission to be there.

Points and her boyfriend told deputies that they had signed a lease agreement to rent the house.

When the victim tried to evict Points and her boyfriend, investigators learned that Points also created a fake quitclaim deed on the house, saying it was given to her for $5,000 and even got the deed notarized.

"Immediately, the judge recognized that it was a forged document," said Deputy Richie Gonzales.

Investigators say when they searched the house it was clear Points and her boyfriend had been living there a while and they also found stolen credit cards, checks and other documents.

What is a quitclaim deed?

A quitclaim deed is a legal document that transfers property ownership from one person (the grantor) to another (the grantee) without any guarantees about the validity or extent of the grantor's ownership. Essentially, the grantor relinquishes any interest they may have in the property, but doesn't warrant that they actually own the property or that the title is clear. 

Investigators tie Points to separate fraud case:

Points is charged in another case where she and her boyfriend, James Simpson and two others, Monica Sutter and Chris Sutter are accused of stealing money from an 85-year-old man with dementia. Investigators say they have found no connection between the Points and Simpson and the Sutters.

They say Monica Sutter met the victim at a Casino shortly after the victim's wife passed away. They say Sutter then married the victim months later and they say she and her son, Chris Sutter, started draining his bank account.

"Through that exploitation investigation, there was, I would say, there was hundreds of thousands of dollars being taken from the elderly gentleman, but none was being put back into his account," said Gonzales.

Deputy Gonzales says Points and Simpson were stealing from the same victim by writing checks to themselves, opening bank accounts, then cashing the checks.

"I don't know if she works or knows how to work. It looks like her whole motive is just to steal and commit fraud and to literally victimize those who don't have a voice," said Gonzales. "We are talking about people who work hard their whole lives and I'm not trying to be cavalier about it, I tell people all the time, go get a job. Go better society."

Monica Sutter, Chris Sutter and James Simpson are all out on bond.

Records show Points has convictions going back to 2011 for drugs, stealing and having stolen property. Records also show Points was given probation last year for fraud and drugs.
