The Rogers County Jail is facing a unique situation.
The Rogers County Sheriff says one of their inmates is on hospice because of cancer.
The Sheriff’s Office has been trying to find a way to get the man released, fearing a lawsuit, if the man dies while in custody.
Scott Walton, the Rogers County Sheriff, says he’s consulted with several people trying to come up with a solution, but no one seems to have an answer.
WHAT’S HAPPENING
Police say Mark Depew had threatened to drive his car into the Catoosa police station in April because he was mad about a code enforcement issue at city hall.
Surveillance video shows he drove to the police station, walked inside, drove off, and was arrested for six counts, including a terrorism related charge.
Depew is now very sick and Sheriff Walton is worried Depew will die while in custody.
"If someone dies in your jail, I think it's probably the most scrutinized death that you would ever have as far as litigation goes along,” said Walton.
He doesn’t want taxpayers to have to pay for a settlement if Depew does die in jail, but he also doesn’t want Depew to get out and find the strength to harm anyone.
He doesn't fault the District Attorney for not wanting to release someone on such a serious charge and says, when they ask for legal advice, no one seems to have clear answers.
WHAT’S NEXT
The District Attorney’s office says it can’t comment on active cases.
The defense attorney listed for Depew in court records says he no longer represents Depew.
HISTORY
Records show the judge did lower Depew’s bond to $65,000 and did order a GPS monitor if he can make bond.
Court records show Depew has previously been sentenced to prison for escape, running from police, and assault and battery.
