A federal judge has temporarily halted the enforcement of an Oklahoma law that would make it a state crime for undocumented immigrants to be present in the state. The decision comes amid legal challenges arguing that immigration enforcement is a federal responsibility.
The law authorizes state and local law enforcement officers to arrest individuals suspected of being in the U.S. illegally. It imposes escalating penalties on undocumented immigrants found within the state.
Oklahoma lawmakers passed the measure in 2023. It was challenged by the Biden administration, which filed a lawsuit to block its implementation. That case was later dismissed under the Trump administration.
Now, a separate group has filed a new lawsuit in federal court. They requested the judge place a temporary hold on the law, arguing it intrudes on federal authority.
The U.S. District Judge agreed to pause the law’s enforcement for at least 14 days, with the hold set to expire on June 3. At that time, the court will consider whether to extend the pause while a broader court challenge plays out.
