OKLAHOMA CITY -
When someone is booked into a jail in Oklahoma, it is standard to find out their legal status.
If the legal status is unable to be confirmed, this is where U.S. Immigration and Customs Enforcement (ICE) gets involved and will request an ICE detainer.
Counties with a contract with ICE
- Having a contract means that the facility serves as a temporary holding facility.
- Logan County Jail is a holding facility housing up to 15 men and 5 women.
- ICE has 72 hours to pick up detainees, who will likely be deported.
Counties without a contract with ICE
- Inmates are not held specifically on ICE holds in jails without a contract with ICE, like the Oklahoma County Jail.
- Once ICE is notified of a person having illegal status in the United States, it will request an ICE detainer for that person.
- Once the inmate has been processed out of serving their time, ICE has 48 hours from the release to pick them up.
The process for inmates with an illegal status
If an inmate is picked up for a crime they have committed, they will serve their time, and ICE will get involved thereafter.
How many detainees are in the different counties to date
- Oklahoma County Jail - within the year, it has grown from about 60 detainers on file to about 100 currently.
- Logan County - Zero on ICE holds
- Tulsa County Jail - About 250 ICE detainees
