Judge Allows Trial To Proceed For Bixby Father In Fatal Crash Involving Teen Daughter

A Tulsa County judge rules there’s enough evidence for a Bixby man to move toward a trial. He’s charged with causing a deadly crash that killed his teenage daughter and injured his wife and two other kids.

A Tulsa County judge rules there’s enough evidence for a Bixby man to move toward a trial. He’s charged with causing a deadly crash that killed his teenage daughter and injured his wife and two other kids.

Investigators say Elliott Binney was speeding and trying to pass another car in a no-passing zone when he crashed near 171st and Memorial.

Officers say Binney left his family and ran from the scene and was arrested later in Checotah. 

In Wednesday’s preliminary hearing, investigators testified that data from the car showed Elliott Binney driving full throttle at 107 miles an hour, two seconds before impact. Two eyewitnesses say it was raining hard, it was dark and Binney was trying to pass on a curvy road.

One eyewitness says she was heading home and noticed Binney behind her trying to pass her and another car.

She says she next saw Binney’s car was airborne next to hers, then it hit the ground and rolled several times.

Both eyewitnesses ran over to the car to help and say while they were trying to help the kids, Binney crawled out of the car and ran away. They say he came back to look for something and left again.

Investigators say Binney walked four miles to his parents’ house, took their car and was later arrested at a gas station in Checotah. Binney’s wife testified she had told Binney to slow down and not pass but he did anyway.

She says he was speeding but not driving erratically. She also said when Binney left the scene, she thought he was looking for their daughter Shelby, who was ejected from the car, and later died.

Binney’s attorney is not arguing whether or not Binney was the driver. When the attorney questioned Binney’s wife, she testified that their car has a lane departure system, and it jerks the car when you drive in the wrong lane and she says Binney over-corrected and lost control of the car.

She also said Binney had a head injury from the crash and does not believe he was in the right state of mind.

She says he would have never left his kids behind if he was in the right state of mind.
